Welcome to Aetherion Gallery. The terms “we,” “us,” and “our” refer to Aetherion Gallery and the legal entity operating Aetherion Gallery (“Aetherion Gallery”).
Aetherion Gallery operates this website and online store, including all related information, content, features, tools, artwork, products, and services (collectively, the “Services”). Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.
These Terms of Service (“Terms”), together with our Privacy Policy and Return & Replacement Policy, describe your rights and responsibilities when accessing or using the Services.
Please read these Terms carefully. They contain important information concerning your legal rights, including warranty disclaimers and limitations of liability.
By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not access or use the Services.
SECTION 1 – ACCESS AND ACCOUNTS
By using the Services, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you have obtained any legally required consent to use the Services.
To browse our store or purchase products, you may be asked to provide information including your email address, billing information, payment information, and shipping address. You represent that information you provide is accurate, current, and complete and that you have the right to provide it.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account.
You may not transfer, sell, assign, or license your account to another person.
SECTION 2 – ARTWORK AND PRODUCTS
Aetherion Gallery offers original artwork, reproductions, prints, canvas products, merchandise, and other art-related products. Certain products may be created, printed, manufactured, assembled, or otherwise produced specifically in response to an order.
We make reasonable efforts to represent our artwork and products accurately. However, colors, brightness, contrast, proportions, texture, and other visual characteristics may appear differently depending on your device, monitor, browser, display settings, lighting, and surrounding environment.
Printed and manufactured artwork may also contain minor variations resulting from the printing, stretching, cutting, finishing, framing, manufacturing, or production process.
Such normal variations are not considered defects.
Where artwork is produced to order, minor variations in cropping, positioning, canvas texture, print placement, finish, or other production characteristics may occur.
Dimensions provided on the website are approximate unless expressly stated otherwise.
We do not warrant that a product's appearance on your particular screen will precisely match the physical product.
Product descriptions, availability, dimensions, specifications, and pricing may be modified without notice. We reserve the right to discontinue products and to limit quantities offered to any person, geographic area, or jurisdiction.
SECTION 3 – ARTISTIC CONTENT AND INTERPRETATION
Aetherion Gallery exists to present distinctive artwork and creative expression.
Certain works may contain imagery, symbolism, satire, humor, sensuality, nudity or implied nudity, innuendo, provocative subject matter, religious or mythological references, depictions of vice, or themes that some viewers may consider controversial, uncomfortable, mature, or offensive.
Art is inherently subjective.
A customer's personal interpretation of, reaction to, or subsequent dissatisfaction with the artistic subject matter of a work does not constitute a product defect.
Customers are responsible for reviewing available product images and descriptions before purchasing.
Nothing in this Section limits any rights or remedies that cannot legally be waived under applicable law.
SECTION 4 – ORDERS
When you submit an order, you are making an offer to purchase the selected products.
Aetherion Gallery reserves the right to accept, decline, limit, or cancel an order where permitted by law, including in cases involving suspected fraud, pricing or listing errors, product unavailability, payment problems, or other legitimate business reasons.
An order is not considered accepted until payment has been successfully processed and the order has been accepted for fulfillment.
Please review your order carefully before submitting it.
Because many Aetherion Gallery products may be produced specifically for an order, we may be unable to cancel or modify an order once production or fulfillment has begun.
Purchases are subject to our Return & Replacement Policy.
Unless otherwise authorized by Aetherion Gallery, purchases are intended for personal or household use and not for unauthorized commercial reproduction or resale.
SECTION 5 – RETURNS, DEFECTS AND DAMAGED PRODUCTS
Because many Aetherion Gallery products are made or produced to order, all sales are final except as provided in our Return & Replacement Policy or as otherwise required by law.
We accept claims involving qualifying damaged, defective, or incorrectly fulfilled merchandise in accordance with that policy.
A change of mind, buyer's remorse, incorrect size selection by the customer, subjective dissatisfaction with an artwork, or differences attributable to screen settings, lighting, personal color perception, or normal manufacturing variations do not constitute defects.
Customers should inspect orders promptly upon delivery.
Claims for damaged, defective, or incorrectly fulfilled products must be submitted within the period stated in our Return & Replacement Policy and should include photographs and other information reasonably necessary for us to evaluate the claim.
The Return & Replacement Policy is incorporated into these Terms by reference.
SECTION 6 – PRICES AND BILLING
Prices, discounts, promotions, and product availability are subject to change without notice.
The price charged will generally be the price displayed when the order is submitted, subject to correction of genuine pricing or listing errors as permitted by applicable law.
Unless expressly stated otherwise, listed prices do not include applicable taxes, shipping, handling, customs duties, import fees, or similar charges.
You agree to provide accurate and current billing and payment information.
By submitting payment information, you represent that you are authorized to use the applicable payment method.
Promotions may be subject to additional terms. If specific promotional terms conflict with these Terms regarding that promotion, the specific promotional terms will govern.
SECTION 7 – SHIPPING AND DELIVERY
Delivery dates and transit times are estimates unless expressly guaranteed in writing.
Aetherion Gallery is not responsible for delays caused by carriers, customs processing, severe weather, natural disasters, incorrect customer-provided shipping information, or other circumstances outside our reasonable control.
However, transfer of an order to a shipping carrier does not eliminate any rights you may have under our Return & Replacement Policy concerning merchandise that arrives damaged.
If an order arrives visibly damaged, customers should photograph the shipping package, packaging materials, shipping label, and damaged product before discarding packaging.
Customers should contact Aetherion Gallery promptly and follow the procedures contained in our Return & Replacement Policy.
SECTION 8 – INTELLECTUAL PROPERTY AND ARTWORK RIGHTS
The Services and their contents, including artwork, illustrations, photographs, graphics, images, designs, text, logos, trademarks, product names, slogans, videos, audio, website design, and other creative materials, are owned by or licensed to Aetherion Gallery and may be protected by United States and international copyright, trademark, and other intellectual-property laws.
Purchasing a physical artwork, print, canvas, reproduction, or other product conveys ownership of that physical item only.
Unless expressly stated otherwise in a written agreement signed or authorized by Aetherion Gallery, purchasing a product does not transfer copyright or any reproduction, licensing, publication, merchandising, digital, derivative-work, or other intellectual-property rights in the underlying artwork.
Without prior written permission from Aetherion Gallery, you may not reproduce, copy, scan, digitally reproduce, commercially photograph, publish, distribute, manufacture, sell reproductions of, create merchandise from, or create unauthorized derivative commercial products based upon Aetherion Gallery artwork.
You may not remove, obscure, or misrepresent copyright, trademark, attribution, signature, watermark, or other proprietary notices associated with our artwork.
Except as permitted by applicable law or expressly authorized by Aetherion Gallery, artwork and other proprietary content may not be systematically scraped, harvested, copied, or compiled for commercial artificial-intelligence training, dataset creation, machine-learning model development, or similar commercial computational uses.
Nothing in these Terms restricts rights that cannot lawfully be restricted, including applicable statutory exceptions or limitations under copyright law.
Aetherion Gallery retains all intellectual-property rights not expressly granted.
SECTION 9 – TRADEMARKS
The Aetherion Gallery name, logos, branding, designs, slogans, including “Unbore Your Walls,” and other source-identifying marks used by Aetherion Gallery may constitute trademarks or other proprietary branding.
Nothing contained in the Services grants permission to use these marks without prior authorization.
Shopify's names, trademarks, and logos remain the property of Shopify or its respective owners.
SECTION 10 – THIRD-PARTY SERVICES AND LINKS
The Services may provide access to third-party tools, payment processors, applications, embedded functionality, or websites.
Third-party services are governed by the terms and policies of their respective providers.
We are not responsible for independently examining or guaranteeing the content, security, accuracy, availability, products, or practices of unaffiliated third-party websites or services.
Your use of third-party services is at your discretion and subject to applicable third-party terms.
SECTION 11 – RELATIONSHIP WITH SHOPIFY
Aetherion Gallery's online store is powered by Shopify.
Shopify provides technology and infrastructure used to operate the store, but purchases from Aetherion Gallery are transactions between you and Aetherion Gallery unless expressly stated otherwise.
Shopify is not the seller of Aetherion Gallery artwork merely because Shopify provides the e-commerce platform through which the transaction occurs.
Certain information may be processed by Shopify as described in applicable privacy disclosures.
SECTION 12 – PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our store is powered by Shopify, certain personal information may also be collected, transmitted, stored, or processed by Shopify and other service providers necessary to operate the Services, process payments, fulfill orders, prevent fraud, provide customer service, or otherwise operate our business.

SECTION 13 – REVIEWS, FEEDBACK AND USER SUBMISSIONS
If you voluntarily submit reviews, photographs, comments, ideas, suggestions, feedback, or other content (“Feedback”), you represent that you have the right to provide that material and that doing so does not violate the rights of another person.
To the extent permitted by law, you grant Aetherion Gallery a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, distribute, and use Feedback for operating, improving, and promoting Aetherion Gallery and its products.
We are not obligated to maintain Feedback in confidence, compensate users for Feedback, or publish or retain Feedback.
We may moderate or remove content that we reasonably believe is unlawful, fraudulent, abusive, defamatory, infringing, obscene, misleading, spam, or otherwise inappropriate.
SECTION 14 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions involving product descriptions, pricing, promotions, availability, shipping charges, transit times, dimensions, or other information.
To the extent permitted by law, we reserve the right to correct genuine errors, inaccuracies, or omissions and to update information.
Where an error materially affects an existing order, we will handle the matter in accordance with applicable law.

You may use the Services only for lawful purposes.
You may not use the Services to:

SECTION 16 – TERMINATION
We may suspend or terminate access to the Services when reasonably necessary, including for violation of these Terms, suspected fraud, abuse, security threats, or unlawful conduct.
Termination does not eliminate obligations or rights that accrued before termination.
Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, governing law, and other provisions that by their nature should survive termination will remain effective.
SECTION 17 – DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
EXCEPT FOR WARRANTIES EXPRESSLY PROVIDED BY AETHERION GALLERY OR RIGHTS THAT CANNOT LEGALLY BE EXCLUDED, WE DISCLAIM EXPRESS OR IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.
SOME STATES OR JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. ACCORDINGLY, SOME OF THESE DISCLAIMERS MAY NOT APPLY TO YOU.
SECTION 18 – LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AETHERION GALLERY AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS.
THIS MAY INCLUDE, WHERE LEGALLY PERMITTED, LOST PROFITS, LOST REVENUE, LOST DATA, OR OTHER CONSEQUENTIAL LOSSES.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
Because some jurisdictions do not allow certain exclusions or limitations of liability, portions of this Section may not apply to you.
SECTION 19 – INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Aetherion Gallery and its owners, officers, employees, affiliates, agents, contractors, licensors, and service providers from third-party claims, liabilities, losses, damages, and reasonable legal expenses arising from your material violation of these Terms, violation of applicable law, infringement of another person's rights, or unlawful misuse of the Services.
Nothing in this Section requires indemnification to the extent prohibited by applicable law.
SECTION 20 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary.
The remaining provisions will continue in full force and effect.
SECTION 21 – WAIVER AND ENTIRE AGREEMENT
Failure by Aetherion Gallery to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.
These Terms, together with policies and other terms expressly incorporated by reference, constitute the agreement governing your use of the Services and supersede prior agreements concerning the same subject matter.
SECTION 22 – ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent except where applicable law provides otherwise.
Aetherion Gallery may assign or transfer its rights and obligations in connection with a merger, acquisition, sale, restructuring, transfer of business assets, or other lawful business transaction.
SECTION 23 – GOVERNING LAW
These Terms and any dispute arising from or relating to the Services will be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.
To the extent permitted by applicable law, disputes will be brought in a court of competent jurisdiction located in the State of Florida.
Nothing in this Section deprives a consumer of protections or rights that cannot legally be waived.
SECTION 24 – CHANGES TO THESE TERMS
We may update these Terms periodically to reflect changes in our Services, business practices, technology, or applicable law.
The current version will be posted on this website with an updated “Last Updated” date.
Where legally required, we will provide additional notice of material changes.
Your continued use of the Services after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by law.
